Full separation of property
For registration in the Danish Personal Register (Personbogen)
This marriage settlement (ægtepagt) is entered into between the spouses named below pursuant to the Danish Act on the Economic Relations between Spouses (ægtefælleloven), Act No. 548 of 30 May 2017. The marriage settlement must be registered in the Personal Register (Personbogen) in order to take effect against third parties, cf. Section 22 of the Spouses Act.

§ 2 The marriage
The spouses are already married. This marriage settlement takes effect from the time it is registered in the Personal Register.
§ 3 Agreement on full separation of property
The spouses hereby agree that all property which each of them owns or subsequently acquires shall be the full separate property of the spouse in question, cf. Sections 30-32 of the Spouses Act.
This means that the property remains with the spouse who owns it upon divorce, separation AND death — and is not shared with the other spouse (apart from inheritance rights under the Inheritance Act).
Note: Upon the death of a spouse, the surviving spouse is not entitled to half of the deceased's property (boslod), but only inherits the ordinary statutory share under the Danish Inheritance Act, cf. Section 9 of the Inheritance Act.
§ 4 Scope
The full separation of property covers:
- All property owned by each spouse at the time of this settlement
- All future property, including income, savings and returns
- Inheritance received by a spouse from a third party, unless the testator has stipulated otherwise
- Gifts from third parties, unless the donor has stipulated otherwise in a deed of gift
- Compensation for personal injury and insurance proceeds for personal injury, cf. Section 31 of the Spouses Act
§ 5 Protection against creditors
The separation of property protects one spouse's assets from the creditors of the other spouse. If one spouse becomes bankrupt, the creditors cannot pursue the other spouse's separate property.
§ 6 Registration
This marriage settlement must be registered in the Danish Personal Register via tinglysning.dk in order to take effect against third parties, including creditors and heirs, cf. Section 22 of the Spouses Act.
Both spouses must sign the settlement digitally with MitID on tinglysning.dk. The registration fee is DKK 1,850 (2026).

Registration endorsement
The settlement only takes effect against third parties from the time of registration. Registration is performed via tinglysning.dk with MitID. Fee DKK 1,850 (2026).
